An FCC Commissioner is saying enough is enough and is pushing for “clear and rational” reforms to the Telephone Consumer Protect Act. Republican, Michael O’Rielly, is now urging for change and for the FCC to protect the automated calls, made legally, from being blocked.

When the TCPA was passed in 1991, it aimed to regulate telemarketing calls, autodialers, pre-recorded calls, texts, and unsolicited faxes to consumers, but O’Rielly argues that because of the way it has been applied, regulations have blocked businesses from reaching out to prospects.

O’Rielly has recently said the Commission should focus on actual occasions of harm and stopping those businesses that are “truly bad actors”. He said “The prior Commission and even some courts have taken the position that simply receiving a couple of stay calls or voicemails constitutes a real harm that can be subject well-intentioned companies to liability… This approach is completely wrongheaded and does not actually protect consumers.” He acknowledges change will not come easy.
