TCPA Fax Suit
A result of violating the Telephone Consumer Protection Act (TCPA), veterinary products company Heska Corp. is set to pay $6.75 million for sending thousands of unwarranted faxes. The class action suit alleges that Heska sent almost 360,000 faxes to over 21,000 fax numbers over the course of three years. Shaun Fauley, lead plaintiff, filed the suit against Heska in 2015 and will get a $15,000 incentive, while counsel Anderson + Wanca will receive $2.25 million – a third of the settlement. In court filings, Wanca found that Heska’s TCPA violation made the company susceptible to nearly $178 million in losses.
