Volkswagen Robocall Lawsuit

A robocall lawsuit against Volkswagen (VW) alleges that the German automaker made robocalls to consumers in violation of the Telephone Consumer Protection Act (TCPA). The lawsuit claims that VW and Peak Performance made calls to consumer cell phones, using pre-recorded and artificial voices or by autodialed live representatives, in attempts to solicit business. VW has a marketing agreement with Peak Performance, who provided customer retention management for Audi and Volkswagen models.

According to plaintiffs, VW did not have consent to call consumers for this purpose – as consumers were under the impression that they provided their contact information for the sole purpose of vehicle service, purchase, or lease information. One customer claims he received calls from Peak Performance on behalf of VW – months after his lease had expired – encouraging him to buy a new vehicle or have his current vehicle serviced.
